Terms of Service

These Terms of Service ("Terms") govern your access to and use of Surveillance Design Studio (the "Service"), operated by Surveillance Design ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization. If you do not agree, do not use the Service.

1. The Service

Surveillance Design Studio is a browser-based tool for designing, simulating, and estimating surveillance systems — including camera placement, coverage and DORI analysis, storage, bandwidth, power, network infrastructure, and related documentation. We may add, change, or remove features over time.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Accounts are organized into workspaces ("organizations"); the account that creates an organization administers it and may invite additional members at assigned roles. You are responsible for the accuracy of your account information, for keeping your credentials secure (multi-factor authentication is available), and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, Billing & Cancellation

The Service is offered under free and paid subscription plans. The features, price, and billing frequency of each plan — and any trial period — are shown at sign-up or in your account. Payments are processed by our payment processor (Stripe); by subscribing you also agree to the processor's terms. Unless stated otherwise, paid subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time, and your paid access continues through the end of the current period. Except where required by law, fees are non-refundable and partial periods are not prorated. We may change plans or pricing prospectively with reasonable notice.

4. Acceptable Use

You agree not to: use the Service unlawfully or to design systems for unlawful surveillance; upload content you lack the rights to use, or that infringes, is unlawful, or is malicious; attempt to breach, probe, or disrupt the Service or its security; reverse engineer, scrape, or resell the Service except as permitted by law; or exceed the usage limits of your plan. You are responsible for complying with all laws applicable to your use, including privacy, notice, and surveillance regulations in your jurisdiction.

5. Design Output & Professional Responsibility

Calculations and recommendations produced by the Service — including coverage, DORI / identification distances (referencing EN 62676-4 values), storage, bandwidth, power, and bills of materials — are planning estimates based on published manufacturer specifications and industry-standard formulas. They do not replace a physical site survey, professional engineering review, or verification of code and regulatory compliance. You are solely responsible for independently verifying any design before it is used for procurement, installation, or the operation of a real security system. We are not liable for decisions made in reliance on the Service's output.

6. Your Content

You retain ownership of the designs, plans, images, and other content you create or upload ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate, secure, and support the Service. You represent that you have the rights and any necessary authorizations to upload Your Content — including site plans and imagery, which may depict sensitive facilities. Your Content is visible to the members of your organization according to their roles.

7. Intellectual Property

The Service, including its software, interface, content libraries, and branding, is owned by us and protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred. AXIS and other manufacturer and product names are trademarks of their respective owners; the Service is an independent tool and is not affiliated with, endorsed by, or sponsored by those manufacturers.

8. Third-Party Services

The Service relies on third-party providers to function — including Stripe (payments), Anthropic (the AI Consultant), and an email provider (transactional email). Your use of features that depend on these providers may be subject to their terms, and we are not responsible for third-party services outside our control.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its estimates will meet your requirements.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service and these Terms will not exceed the greater of the amounts you paid us in the twelve months before the claim or US$100.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, or your breach of these Terms or of applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to the Service and These Terms

We may modify the Service or these Terms. If we make a material change to these Terms, we will update the version above and provide reasonable notice. Your continued use after the change takes effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Alabama, and you consent to the personal jurisdiction of those courts.
